Indonesia Hospital Tender Registration: Why Public Hospital Bids Require an Izin Edar You Do Not Yet Have

Indonesia hospital tender registration is often where foreign manufacturers make their first major misstep long before any bid is actually written. A public hospital tender can feel like an obvious win, there is a clear buyer, an allocated budget, and precise technical specs. But momentum grinds to a halt the moment the procurement team asks for a registration number that does not exist yet.

Most companies fall into two common traps: assuming a device can be registered after winning the contract, or treating special access mechanisms as a standard sales channel. Both mistakes stem from understandable logic, but they almost always surface late in the process, after budgets are set and distributor negotiations are well underway.

In practice, a device must already hold a valid izin edar (marketing authorization, issued as AKL for imported products or AKD for domestic ones) at the exact moment a bid is submitted. Winning first and registering later simply is not an option, and special access (jalur khusus) in certain situations, not a commercial route.

This guide clarifies those regulatory boundaries for manufacturers, exporters, and distributors targeting Indonesian public healthcare opportunities. It also gives regulatory and commercial teams the exact framing they need to explain to executive leadership why market authorization must precede the tender, not follow it.

Here is what you will get out of this guide:

  • Why e-catalogue standards and import rules enforce the exact same gatekeeping requirements
  • What special access actually permits, and where its legal boundaries lie
  • The essential documentation required for special access filings
  • The single free-sale certificate (FSC) question that determines whether to invest in Indonesia immediately or hold off

What Indonesia Hospital Tender Registration Requires

Indonesia hospital tender registration means the product’s izin edar, either AKL or AKD, must already exist when the bid is submitted. The electronic catalogue asks for the registration number (NIE) as a product attribute. Special access is an exception route requiring the Minister’s approval, not a sales route.

Legal basis: Permenkes No. 5/2026 on Perbekalan Kesehatan (Ministry of Health, Arts. 42, 58 and 62), and Perpres No. 16/2018 on government procurement as amended by Perpres No. 46/2025 (President of the Republic of Indonesia, Arts. 50 and 66). Each is discussed below.

Why the Tender Requires Registration You Do Not Yet Have

Import Is Allowed Only After Izin Edar

Permenkes No. 5/2026 on Perbekalan Kesehatan (health supplies) was set by the Minister of Health on 17 April 2026 and has applied since 4 May 2026. It replaced Permenkes No. 62/2017. Article 58(4) allows devices to be imported only after izin edar is granted.

That single rule explains the sequence. Registration is not a post-award task, because the product cannot enter the country for supply without izin edar. Outside special access, there is no import first, register later path, and a contract award does not change this.

Catalogue Purchasing Leaves Little Room

Under Article 42(1) and (3) of Permenkes No. 5/2026, government agencies must buy through the electronic catalogue. So must government or private facilities that run JKN or other health programmes. Other methods are allowed only where the catalogue cannot be used.

Perpres No. 16/2018 on government procurement, as amended by Perpres No. 46/2025, makes e-purchasing mandatory when an item is in the catalogue (Art. 50(5)). Peraturan LKPP No. 2/2026 sets the catalogue framework from 1 September 2026. LKPP is the national public procurement policy agency.

The listing platform has also changed. The drugs and devices showcase of Katalog Elektronik v5 was deactivated on 30 September 2025 under SE Kepala LKPP No. 2/2025, and listing now runs on v6. In our experience, a product without izin edar has nothing to list.

How Domestic Content Rules Shape Hospital Purchases

Even a registered foreign product is not safe in a catalogue. Permenkes No. 5/2026 (Arts. 41, 42(4) and 44) requires the catalogue to favour domestic content, and imported products in it can be substituted by domestic ones. Perpres No. 16/2018 (Art. 66) also puts domestic products first.

TKDN (Tingkat Komponen Dalam Negeri) is the domestic component level of a product, and BMP (Bobot Manfaat Perusahaan) is the company benefit weight. The ladder above comes from a Ministry of Finance training slide, so its application to a specific device should be confirmed before any bidding decision.

The practical message is that registration is the entry ticket, not the whole contest. A foreign product still competes against domestic alternatives on content value. Teams that understand this early plan registration, TKDN evidence and distributor commitments together instead of treating them as separate projects.

Is Special Access a Route to Sell to Public Hospitals?

Short answer: no. Special access (jalur khusus) lets the Minister of Health approve import without izin edar for specific purposes. It is an exception route. Approval is not a licence to supply hospitals commercially, and the purposes are listed in the regulation itself.

What Article 62 Permits

Article 62(5) of Permenkes No. 5/2026 allows approval for health service, research, government programmes, social service, exhibitions, personal use, or other purposes the Minister sets. The technical guideline is still to be issued (Art. 62(9)), so practice remains in transition.

The old special access rules, Permenkes No. 51/2014 and Permenkes No. 7/2020, are repealed. Article 124 keeps existing implementing rules in force where they do not conflict. This is why we work from an older guideline for now, and why any filing needs current expert confirmation.

The Checklist We Currently Work From

PRI Regulatory Affairs summarised the older Kemenkes jalur khusus guideline on 1 October 2026. It is transitional and not final. Under it, an application asks for the items below, and the exact list may change once the technical guideline under Article 62(9) is issued.

  • Proof of registration, or a free-sale certificate (CFS), from the country of origin
  • A stamped statement that the device will not be sold in Indonesia
  • A utilisation report
  • For a government programme, recommendations from the programme head and the Medical Committee (Komite Medik)

Why the Not-for-Sale Statement Blocks Sales

The stamped not-for-sale statement is the clearest signal. A device imported under special access is not meant to be sold, so tender participation and commercial supply sit outside its purpose. In our experience, this single document often ends sales-driven special access plans before they start.

Medical Device Registration in Indonesia: Two Cases from Our Files

A Proton-Therapy System With No Home Certificate

A foreign proton-therapy system, built under licence, had no free-sale certificate in its home market. It was aimed at a planned public hospital project. Our first screening question was whether registration was driven by a hospital or distributor commitment, or by market exploration.

That question matters because, under the checklist we use, a missing home certificate closes both full AKL and non-donation special access. Spending on dossiers and local partners can run ahead of any approval that could support a bid. Radiation rules add more, as our guide to high-energy therapeutic equipment explains.

A First-Aid Supplier and an Emergency Government Purchase

A first-aid supplier planned special access for an emergency government purchase. We flagged the not-for-sale statement as a problem, because government exposure would follow the importing entity. The supplier then faced two quoted routes, which we compare below as one-case figures, not promises.

Indonesia Medical Device Registration: Routes Compared

In our experience, full AKL through licence holding was quoted at about three months, while special access was quoted at two to four weeks with an agency recommendation. Timelines vary by product and review queue, so treat these as one-case figures.

Table 3. Registration routes compared

RouteIzin edar before bid?Key requirementsFit for public hospital sales
Full AKL (imported device)Yes, granted before the bidRegistration through a licence holder; risk class set under Kemenkes rulesYes, product can be listed and bought
AKD (domestic device)Yes, granted before the bidRegistration of a domestically made deviceYes, and favoured by domestic content rules
Special access (jalur khusus)No, Minister’s approval insteadCFS or proof of registration, stamped not-for-sale statement, utilisation report, agency recommendationsNo, not a sales route

Risk class drives the evidence and local testing that follow, as our article on medical device risk classification explains. A local licence holder carries the registration for an overseas manufacturer, which PRI supports through its licence holder service. The full journey is mapped in our process guide.

Closing Decision: Do You Hold a Free-Sale Certificate?

Before any spending, answer one question: do you hold a free-sale certificate from the country of origin? If not, neither AKL nor a non-donation special access is open under the checklist we use. The decision then becomes whether to wait for home approval.

2. Is a hospital or distributor commitment driving registration?Ask a specialist to match AKL timing, TKDN position and catalogue listing to the bid datesTreat it as market exploration: plan full AKL first, and bid only after registration number (NIE) exists
3. Does the plan rely on special access to sell?Re-plan, because special access is not a sales routeContinue with the AKL or AKD route

Conclusion: Register First, Then Bid

Indonesia hospital tender registration rewards manufacturers who prepare early. The rules are firm, but they are predictable once you see the sequence: izin edar first, catalogue listing second, bid third. With early expert review, most expensive surprises surface long before a tender deadline.

Product Registration Indonesia (PRI) helps manufacturers and importers confirm the right registration route, check free-sale certificate readiness, and align the dossier with tender timing. Our team can review your device and project with you, so you avoid paying for the wrong route.

Frequently Asked Questions (FAQ)

What does Indonesia hospital tender registration require?

Indonesia hospital tender registration means holding a valid izin edar (AKL for imported devices, AKD for domestic ones) before the bid is submitted. Under Permenkes No. 5/2026 (Art. 42), government agencies and JKN facilities must buy through the electronic catalogue, where the registration number (NIE) is a product attribute.

Can a manufacturer register a device after winning a hospital tender?

In our experience, no. The izin edar, either AKL or AKD, must already exist when the bid is submitted. Permenkes No. 5/2026 allows imports only after registration number (NIE) is granted (Art. 58(4)), so registration cannot follow the award. Early planning with a specialist is essential.

Is special access a way to sell to public hospitals?

No. Special access (jalur khusus) needs the Minister’s approval for a listed purpose under Permenkes No. 5/2026 (Art. 62(5)). Under the checklist we work from, it also asks for a stamped statement that the device will not be sold in Indonesia, so it is not a sales route.

Which documents does special access ask for?

Under the older Kemenkes guideline we currently use, which is transitional, special access asks for proof of registration or a free-sale certificate from the country of origin, a stamped not-for-sale statement, and a utilisation report. Government programmes also need recommendations from the programme head and the Medical Committee.

Why does medical device registration in Indonesia matter if hospitals buy through the catalogue?

The catalogue is the purchasing channel, and registration is what allows a product into it. The Kemenkes sectoral catalogue requires the NIE and TKDN value as attributes, and Perpres No. 16/2018 (Art. 50(5)) makes e-purchasing mandatory once an item is listed.

Do I need a free-sale certificate for Indonesia medical device registration?

In our experience, yes, it is central. Without a certificate from the country of origin, neither AKL nor a non-donation special access is open, so the decision becomes whether to wait for home approval. A specialist should confirm the current position for your device.
